Subsequently, the developer decided to close the road from 5:00 p.m. to 6:00 a.m. following several complaints from subdivision residents of the noise from the motorists. Heeding the clamor of motorists, the city government urged the developer to open the road 24-7 arguing that the road has been customarily used by the public, as such, the developer has no right to close the road on certain hours. Further, the city government filed a case to compel the developer to do so. The developer turns to you for advice, asking you if the subdivision has an obligation not to close the road on certain hours. What is your advice? Give your legal basis.
