HERE IS THE SCENARIO:

You have a potential client who came into your office who would like to file a refugee claim.

Mr. John Doe had a business in Brooklyn, NY (USA), which was very successful. As per his statement, gang members came to his place of business to ask for payments in order to allow him running his business, otherwise his retail store would be destroyed. Gang members also threaten his family members (wife and two kids).

The applicant refused to pay and contacted local police. A police unit interviewed him and found no real threat. A police officer also didn't know whether this was a real gang. Police took some notes but never investigated the matter further.

After one month, gang members came to his place of business and completely destroyed the place. They also injured Mr. Doe and they also stole some of his inventory and cash that was in the register. Mr. Doe contacted the police immediately, they took the report and said they would investigate. Nothing happened. Mr. John Doe didn't have the insurance and had to rebuild everything by himself.

After another month, gang members came again, and were about to destroy his place, however John Doe had a gun and killed everyone in self-defense. After investigating this matter, police were about to charge John with a murder, he escaped to Canada.

QUESTIONS:

1. How is able to come to Canada or enter the POE when he is charged of murder in Brooklyn, NY?
2. Can they really charge him for murder when it is a self defense? Can it be really called self defense?
3. Is he eligible to seek refuge in Canada?
4. Does him not applying for a refugee claim at POE may disqualify him?
