- Jeff is a waiter at Fred's caf. Jeff is usually polite in his dealings with the public but is quick to take offence if a customer is rude to him. One day Michael, a customer, complains to Jeff that the service at the caf is terrible. Jeff tells him if he does not like it he can go elsewhere. Michael refuses to leave and demands to be served straight away. Jeff says "get lost!" Michael eventually decides to leave and starts walking towards the door. As he leaves he mutters something about Jeff being a hopeless waiter. Jeff hears this and charges at Michael, grabbing his jacket. Michael is unharmed but the jacket, an expensive designer label item, is torn and badly damaged. The cost of the repair to the jacket is estimated to be $500. Chapter 11

- Chris is a keen gardener. To control the weeds along the fence between Chris's property and that of Pat, Chris sprays some weed killer. The instructions on the product say that it is quite safe and will not harm flowers, vegetables, or most fruit plants. Chris is very careful in using the spray and chooses a day when there is little wind. However some spray does penetrate the fence on to Pat's property. Unknown to Chris, Pat is trying to grow some raspberry canes along the fence line. Raspberries are especially sensitive to the weed killer used by Chris and Pat loses some $450 worth of canes. Chris sells three slices of a pat de veau aux pinards en crote which is a rather nice pie made with veal layered with spinach, forcemeat, ham and bacon, to Pat. Pat takes the slices home intending them for the evening meal. That afternoon Jo, Pat's teenage child and Jo's friend Toni, are in the kitchen looking for something to eat. They each eat a slice of the pie. As a result of Chris's poor food-handling techniques the pie is contaminated with salmonella bacteria and Jo and Toni are very sick. Since salmonella is a disease, not an injury covered under the Accident Compensation Act 2001, they wish to sue Chris. Chapter 11
