QUESTION 5 5 points Save Answer Scenario 1: Pascal and Jasper were on a trip in the outback in New South Wales. Jasper was 17 years and had very little driving experience. He did not even hold a driver's licence or learner's permit and Pascal was aware of this. On two occasions on the trip, Pascal allowed Jasper to drive his Mazda station wagon for short periods of 30 to 40 minutes, Pascal sat beside Jasper in the front passenger seat. On the third such occasion when jasper was driving, there was an uprooted tree on the road and Jasper tried to steer around it by veering to the right side of the road. However, there was oncoming traffic and Pascal yelled at Jasper to brake but he did not. Instead, Jasper made a sharp left turn and accelerated. The vehicle rolled. Pascal sustained spinal injuries in the accident and was rendered a paraplegic. Upon leaving hospital Pascal now approaches you for advice on whether he can take action against Jasper in negligence. Question PART B Advise Jasper whether his inexperience as a driver and the fact that he did not even have a drivers' licence would in any way affect the standard of care that he may owe to Pascal.
