Hi, I need an answer for student A side in the following question;
ASIC has come under fierce criticism for its inability or unwillingness to prosecute breaches of continuous disclosure. In April 2016, the AFR (see article) reported that Chi-X was seeking exemptions from continuous disclosure for US companies listing on its platform. The ASX tried and failed in a similar move in 2012 because ASIC was concerned US companies would not be subject to our CDR. Two members of ASIC are discussing the implications of this news and hold opposing views.
One member(Student A)argues that difficulty enforcing ASX 3.1 is damaging for firms. If Chi-X gains its exemption, then Australia would be better just adopting the US approach.
The second member (Student B)supports full continuous disclosure and argues that it is effective, and the drawbacks of the US system are not wanted in Australia.
