QUESTION 9 Rory wants to sell his Toyota Hi-Lux, and writes on the back window some details about the vehicle and only a mobile number to call. He gets an inquiry from Bart, who requests more information about the vehicle. Rory askes for Bart's email address, and then emails him some more photos, and some other information about the vehicle. He also tells Bart that there is another person interested in buying the car. They text and email back and forth several times with Bart asking for more details and trying to reduce the price. Rory gets a bit annoyed with Bart and tells him \"Send me an email before 8pm if you want it or not\". Finally, Bart decides to buy the vehicle and at 7.30pm he emails Rory from his girlfriend's email account to tell him he wishes to buy. However, the email goes into Rory's \"Spam\" folder in his email account, and Rory never sees the message. At 9pm, when he is contacted by the other interested person, he agrees to sell it to them. The following day Bart phones Rory again to arrange payment. Rory says that Bart is too late, and that he has already sold it to someone else and received payment. Bart is angry, and tells Rory that he emailed before 8pm as Rory instructed. Rory discovers the message in his Spam folder, but figures that it hadn't come from Bart's email account, and that he can't be held responsible for that. Rory was approached by Bart, who inquired to buy his Toyota Hilux. Following phone and email conversations to gather more information, Bart is given until 8:00pm to decide whether or not he agrees to purchase the vehicle Rory informs him that another party is interested. Bart emailed Rory at 7:30pm, intending to purchase the vehicle, but his email was not received, he was later informed that the vehicle had been sold to a third party at 9:00pm. Despite the fact that he had emailed Rory on time, Bart is told that his email is invalid due to the use of a different email address Rory claims he cannot be subject to blame for Ba rt's mistake. ISSUE: The issue in this case is whether there was a valid acceptance of offer between Rory and Bart in terms of the sale of Rory's Toyota Hilux.
