Hi, I'm writing a legal research essay on whether or not to abolish the constructive murder rule in NSW, Australia (otherwise know as the felony murder rule).
I'd like some instruction on what research essays should look like- largely, I don't have a clear idea on what markers are looking for. Is it important to examine the history in the construction of the rule and its evolution (if so, how important is it to the final essay - is spending 20% on this too much)? Is it worth a brief mention? In which case, for the constructive murder rule do I track it to its roots in English law or start from the reception in Australia?
Otherwise, is modern reception more important?
I know there was a law commission report around 2010 on complicity which talked about the constructive murder rule. Is this the most recent review on the law?
Essentially, I'm not sure what reasoning usually justifies the abolition of a law.
