Question 2 (Marks. 20) Thami, Thomas and Tapiwa are at a sports bar watching a soccer match. The team that Thami and Thomas support loses the match, and they are both very upset because they put a R 5000 bet on their team to win the game. Tapiwa is a supporter of the opposing team, as such, the team that won the match. Tapiwa is celebrating by mocking Thami and Thomas. Tapiwa's behaviour infuriates them, and an argument ensues. Tapiwa punches Thami in the face and a scuffle breaks out. Thomas holds Tapiwa's arms behind his back while Thami punches Tapiwa in the stomach. Tapiwa falls on his knees while this is happening. Another patron at the bar, Barry, tries to stop the fight and is calling for everyone to calm down and not to continue fighting. Barry helps to pick up and steady Tapiwa on his feet but in doing so, he lifts Tapiwa up too quickly and this cracks a few of Tapiwa's ribs. Thami pushes Barry to the side, grabs a steak-knife from a nearby table and Thami stabs Tapiwa several times. Tapiwa collapses and is lying unresponsive on the ground in a pool of blood. By this time, police enter the sports bar, arrest Thami and Thomas, and they make way for the paramedics to attend to Tapiwa. Answer the following questions: Q.2.1 Discuss the criminal liability of Thomas and Barry as co-perpetrators in the context of the doctrine of common purpose. Q.2.2 Another patron at the bar, Toni, was witness to the scuffle and he also could ( 20) not tolerate Tapiwa's behaviour. After Tapiwa had been stabbed and was lying on the floor, Toni walked up to where he lay and he kicked Tapiwa in the back twice.21; 22; 23 2022 Explain the category of persons into which Toni would fall with regard to committing a crime
