Scenario You have received the following email from Mr Charles Leighton regarding an upcoming staff meeting.

Hi there, To ensure professional development is maintained in the firm, we hold regular meetings during which staff are nominated at random to make a presentation about various aspects of the law. I have nominated you to prepare the presentation for the next meeting. Accordingly, I need you to complete the following work. Your audience will be Paralegals and Solicitors of the Firm. Please undertake research and prepare a PowerPoint presentation using Leighton+Costello's PowerPoint template about the following.

Part A: Differentiate between civil and criminal proceedings, in particular:

a) Identify and explain the primary differences in law and legal procedures between civil and criminal proceedings; and

b) Select three (3) different types of civil matters and determine which court would hear that particular type of case.

c) Select two (2) different types of criminal matters and determine which court would hear that particular type of case.

PART B

Provide an examination of the elements of the adversary system of trial, particularly canvassing the following:

a) Identify the main features of the Adversary System of trial, including but not limited to the following:

o the parties involved and their control over cases;

o the 'running' of a trial as a single event;

o who controls the running of the trial; and o who makes decisions (both interim/procedural decisions and final decisions).

b) Evaluate these features and explain how they apply in our legal environment. Ensure you consider:

o the advantages and disadvantages of this system. (Compare this system to other systems such as the Inquisitorial System etc.)

o the role of the judge

o the role of the jury

o People who are selected for juries may be exempted, ineligible or disqualified. Give one example of:

a) Exemption from jury service

b) Being ineligible for jury service

c) Disqualification from jury service

You will also need to ensure that you proofread for errors and apply correct formatting and file naming protocol when saving files in according to the Firm's policies and procedures manual.
