Scenario:

An exclusion clause is on a sign at a shop counter e.g., "This store accepts no responsibility for breach of any warranty".

The non-defaulting party (the buyer) happens to see the sign upon finalising the order, but the defaulting party (the shopkeeper) does not bring any attention to the sign. Is the exclusion clause valid?

Is there any case laws related to this scenario? (seeing the sign, but not having it pointed out) I can't find any.
