Hilda, our client at the law firm of Hamer, Huerta, Jordan, and Yousafzai, was furious that Sadie requested additional time to complete tasks, a sign language interpreter, a special chair, and use of the women's restroom. Hilda argued with Sadie while they were discussing the matter at a local bar. Hilda was inches from Sadie's face, screaming at Sadie. Sadie was disgusted and scared that Hilda was so close to her while screaming. In response, Sadie pushed Hilda away. Hilda lost her balance and fell into Willard. Willard then lost his balance, fell face-first onto the tile floor, hit his head, and died at the scene.

Terrified about what occurred, Sadie fled the scene and drove home. While driving home, she hit another car. The driver of the other car was pronounced dead at the scene. When the police caught up with her, they administered a breath test to Sadie, who failed it. She was arrested for driving under the influence.

Sadie has asked your firm to defend her.

Makee a memo addressing the following:

1. With what crimes can Sadie be charged under the penal code in your home state (California) ? Cite the law. If Sadie was interested in pursuing a plea deal, what type of plea deal would you discuss with the prosecutor?
2. Can Hamer, Huerta, Jordan, and Yousafzai, represent Sadie, or are there some ethical concerns? Cite the Rules of Professional Conduct in your home state and explain your conclusion.
3. Sadie was advised there will be an arraignment. What is that, and what if, anything, does Sadie need to do?
4. Explain why you think the prosecutor in your home state would pursue this case by filing information or by an indictment?
5. Sadie was charged with several crimes given the facts presented. Assuming your firm can represent Sadie: your firm has learned from a reliable source that the prosecutor may have information related to a faulty breathalyzer device and that a witness stated that someone else may have pushed Willard. Is the prosecution required to provide this information (about the witness and breathalyzer test) to Sadie's attorney? What is the Brady rule and what would you argue on behalf of Sadie?
6. Now assume that Sadie does not have a great deal of money. She cannot hire an expensive attorney. Explain what access to justice issues are related to this sort of factual scenario, and make suggestions about how to reduce the legal burdens associated with such problems.
