Hoffman was told by the Red Owl supermarket chain that he would be granted a franchise to open a store if he sold his bakery in Milwaukee, acquired a tract of land in Chilton, Wisconsin and put up $6000. In reliance on that promise, Hoffman sold his business and acquired the land but was never granted a franchise. When Hoffman sued, Red Owl contended that their promise was not enforceable and Hoffman had no right to a recovery since Hoffman had provided no consideration.
