Hong Kong Business Law Question On September 1st, 2020, A signed a contract with ABC Limited to design and produce the clothes for all the performers in a forthcoming opera shows with the leading artist, B, taking the major role. The opera shows will start on December 1st, 2020 and last for 2 weeks. A was paid HK$25,000 in advance and was told that the balance of HK$75,000 would be paid on completion of production of all the clothes. In order to complete the design and production works on time, A paid HK$30,000 to buy necessary materials and supplies from C, who assured A that he would be able to deliver the materials and supplies within two weeks (i.e. before September 16th, 2020). Actually, when C gave this assurance, he knew that he was having considerable difficulty in providing those materials and supplies on time due to shortage of suppliers in the market. Two months later, whilst A was still waiting for the materials and supplies from C , ABC told A that the company decided to cancel the opera shows as B died in a flight accident. ABC also told A that they would no longer require A to design and produce the clothes and ask A to refund the advance payment of HK$25,000. Discuss the case. Advise A on her legal rights.
