Hello Everyone. The US., government has three branches because James Madison realized that having only a state and federal government would fear a stronger national government from them (icivics, 2023). The important of the United States having three branches is to make sure that those in power don't become abusive with it. The branches are executive, judicial, and legislative. The U.S. President is in the executive branch which can veto any law passed by the legislative which is Congress (&ics, 2023). Congress can veto any law that is made by the president. The Judiciary interprets the laws made by the President and Congres to make sure that it aligns with the Constitution (icivics, 2023). In regards to the separation of powers, the Court said that the Judges from supreme and inferior courts shall hold their offices during good behavior and get compensated for it (National Constitution Center, 2024). Also, the Supreme Court has original jurisdiction over cases that involve politicians and appellate jurisdiction over cases with two or more states, state and citizen, foreign states, and citizens claiming lands under grants of different states (National Constitution Center, 2024). No, the President can't always hide everything from the other branches because everything they do is overseen by the Supreme Court and Congress. The University of Texas's use of race as a consideration in the admission process does not violate the Equal Protection Clause of the Fourteenth Amendment. The Equal Protection Clause of the Fourteenth Amendment refers to a state making a law and not college policies. Also, race wasn't the only factor to determine the admission of a student but, educational qualifications serve as a compelling state interest | (Fisher v. University of Texas). One reason affirmative action was considered necessary so that racial inequality and racial exclusion can be addressed in society (Shafer, 2018). Racial inequality and racial | exclusion were addressed through colleges admitting more black students and giving them the resources that they needed (Shafer, 2018). Another reason affirmative was considered necessary is so that | discrimination and inequality can be removed from the workplace. | do believe these reasons still exist today because schools and the workplace are still being discriminated against. My opinion on affirmative action in college admissions does differ from my opinion on hiring, employment, and money-lending. | believe colleges are more likley to not discriminate than the workplace. They may have a limited amount of number of people that they have to admit while an employer from a private job may be able te go about their way on how diverse they want it to be. If | were in charge of hiring employees for a business, | would ask the right questions to minimize unconscious mia'l, ethnic, and gender-based bias. | would ask them meaningful questions to make sure that they are comfortable working in a diverse workspace. | would not tell them that certain positions are only for men and women.
