How would this business memorandum look like ?
Directions Initial Post [Due: Tuesday at 11:59. PM... CT.] The year is 1996, and you are the Health Information Management Systems {HIMS) Director for Steel Toe Regional Hospital in Pleasant, Texas. This is a small rural hospital where members of the leadership team have a tendency to take on a number of collateral duties. In addition to being the HIMS Director, you are also doubling as the Compliance Ofcer. The organization is preparing for the implementation of the recently enacted Health Insurance Portability and Accountability Act (HIPAA). You have been tasked by the Chief Executive Officer, Ms. Dana Foster, to examine the potential impact the law will have on the organization, and then present a recommendation on how best to ensure the hospital is prepared to come into full compliance with the law. Instructor Note: When laws are first enacted, they frequently phase In provisions allowing organizations time to make necessary changes to come into compliance. As soon as these laws are passed, organizations need to become familiar with the law and its' various provisions; assess its\" impact on the business; and then determine what internal changes are necessary to come into compliance. We do this even though there is a high probability at the law or certain provisions within the law will be challenged in the courts. Organizations cannot wait for legal judgments to begin their efforts to come into compliance. The reason this case is set back in 1996 is because HIPAA was signed into law in that year. You are expected to prepare a recommendation on what actions the hospital should undertake in order to ensure that it comes into compliance with the Act. As you prepare to formulate your recommendation, you may want to consider your answers to the following questions: 1. What is the overall purpose and intent of the Act? 2. What are the key provisions within the Act? 3. What prompted the passage of the Act? 4. What policies and procedures have other hospitals put in place to comply with the Act? Can hospitals do less than the law requires? Can hospitals do more than the law requires? What are the consequences for not complying with the Act? 9"???" What challenges have hospitals experienced complying with the Act? 9. What are the estimated costs {direct and indirect) associated with coming into compliance with the Act? The recommendation should be written into a business memorandum and made to the attention of Ms. Foster. Ms. Foster is not expecting a detailed recommendation complete with action plan. She knows from experience that coming into compliance with laws as complex as HIPAA will take a ton of work and will have a lot of moving parts. At this point, however, Ms. Foster wants you to develop a high level recommendation that lays out a process for ensuring the hospital comes into compliance with this federal law.
