General Information:
This Arbitration hearing is dealing with a discipline case involving a sanitation worker (garbage collector) at the corporation of the City of Pleasantville.All steps of the grievance procedure have been exhausted.The case is being heard by a single Arbitrator.
The initial grievance is worded thus:
The Union grieves that Management has violated Article 5:01 of the collective agreement in that Mr. Herman, the griever, has been unjustly disciplined by management.The Union demands that the letter of reprimand for Mr. Herman be removed from his personnel file, and that all references to this disciplinary action be removed from Mr. Herman's personnel file.
All answers to the grievance from management at each step of the grievance procedure read "the grievance is denied".
Article 5:01 of the Collective Agreement reads:
The Union acknowledges that it is the exclusive function of the Company, subject always to the provisions of this agreement, to hire, promote, transfer, suspend, discharge, or otherwise discipline any employee for cause, provided that a claim by an employee that he has been discharged or disciplined without reasonable cause may be the subject of a grievance and dealt with as herein provided.

Company Radios are to be used for official company business only.Radio operators are to be courteous and use appropriate language at all times.Any use of company radios for non-company reasons, or use of foul language on the radio will result in disciplinary actions.
