This was a civil case because it was a dispute over federal regulations between a government agency and a non-profit organization and didn't involve any criminal charges.

Remedies Sought

The Plaintiffs sought that the Federal Motor Carrier Safety Administration would enforce the National Environmental Policy Act and the Clean Air Act. And they would do this by conducting an Environmental Impact Statement before granting operating authority to Mexican Motor carriers. In addition, the Public Citizen also sought that FMCSA would be prevented from processing applications from Mexican motor carriers until the FMCSA complied with both NEPA and CAA.
