Jacob, who is physically challenged, after returning to his brand new BMW found out that someone had stolen all his petrol. Whilst he was there in disbelief, he saw Tasha, a newly recruited member of the JCF. He told her what had happened and she said: "Don't worry sir, I will catch these criminals for you". He replied: "Thank you so much, and for that I will pay you $300". James who was eavesdropping offered to get some petrol for Jacob. Jacob gave James a container and $100 as payment for the petrol. Thereafter, James returned and Jacob said: 'Thank you for your trouble. I do not have any more money with me.'
Tasha caught the thief but Jacob has refused to pay James and Tasha.
Your supervisor has asked you to prepare a legal memorandum. In that memorandum you should advise him as to whether James and/or Tasha has a claim against Jacob.
