COURT CLERK: Andrew Goodman is charged on the 22nd day of October, 2019, at 10:36 a.m. at Elmira Road North and Massey Road in the City of Guelph with the offence of interfere with traffic, contrary to the Highway Traffic Act, Section 170(12). where is the authority in law for you to agree to it and for me to make an order I have no authority to make? OLEWUIKE: Your Worship, we feel that we wanted to have a joint submission of the $200 penalty, and since the maximum for the 170(12) Section is $100, we had the resolution discussion that we've come to an agreement to change the section and kept the penalty of $200 plus fine and court costs. So Madam Prosecutor if I'm being tough on you it's because I thought this has been dealt with, and I am amazed that I'm being asked to commit an illegal act with your agreement in this court. THE COURT: But you're now asking me to do something you cannot justify in law and that is in order for me to have to change the legal position I've taken on the plea that has been entered in front of me, you want to switch your plea to something else and you can point out no law that would allow me to do that.
