Negligence Practice Questions

  1. A woman (Cynthia) was in the 27th week of her pregnancy. While driving through a snowstorm, she lost control of her vehicle on a patch of slush and struck an oncoming vehicle. The infant was allegedly injured while in utero, and was delivered prematurely later that same day. He suffered from permanent mental and physical impairment.

See Dobson (Litigation Guardian of) v Dobson, [1999] 2 SCR 753.

  1. Mr. Heimler was a guest at a wedding reception where he partook in the usual food and drink. A few days afterwards, he became ill with typhoid fever. A number of other wedding guests also contracted typhoid. After an investigation, it turns out that one of the caterer's employees responsible for handling food tested positive for typhoid. Apparently, she had used the bathroom and not washed her hands afterwards.

See Heimler v Calvert Caterers Ltd. (1975), 4 O.R. (2d) 667.

  1. You go to see a doctor about an infection in your foot. Your doctor hasn't kept up with the latest medical literature and misses the seriousness of your infection. Instead, she tells you to go home and that your foot will be fine. Unfortunately, the infection doesn't go away, and you end up having to miss a few months of work while it heals. You sue for negligence, but the expert evidence suggests that even if the doctor had identified the seriousness of the infection, there would not have been anything to speed up the recovery, and your prognosis would not have been any better.

  1. Culligan supplied water to an office. In the course of replacing an empty bottle of water with a new one, Mr. Mustapha saw a dead fly in the unopened replacement bottle. He developed depression and anxiety and sued Culligan for damages.

See Mustapha v Culligan of Canada Ltd., [2008] 2 SCR 114.
