I need help writing a case summary which requires to locate a leading case for their chosen topic and at least one case that "followed" or had "positive" treatment of their case. The "following" case should be one that was impacted as a whole by the leading case, or at the very least, held a positive treatment of the leading case on a legal issue of interest to the student. No analysis is needed for the "following" case, other than an explanation of why it was chosen (be sure when citing it to cite the paragraph where your leading case was cited). Once located, the student will break down the leading case, noting the legal issue, and the ratio decidendi in the decision. The analysis of the case findings and their impact should be compared to the student's chosen topic/legal issue with an explanation of the leading case's overall value. Refrain from merely stating your leading case is "important," or some other similar phrasing, to your topic. It's not enough to state that, you need to explain the value to your work not just state the value of it. Here is my topic: Abortion The federal government passed new measures to restrict access to abortions. Provinces will now have committees that are meant to grant approvals to women who wish to have an abortion. Abortions are to be carried out at an approved hospital after receiving approval from the committee. A new code section was also added to the criminal code (s. 288) making it an offense to carry out an abortion in any other manner. Doctor Bradley has publicly opposed the new laws around abortion and opened her own clinic and conducted 10 abortions. She has been charged with violating s.288. The new code section reads as follows: Procuring miscarriage 288 (1) Every one who, with intent to procure the miscarriage of a female person, whether or not she is pregnant, uses any means for the purpose of carrying out his intention is guilty of an indictable offence and liable to imprisonment for life. Marginal note: Woman procuring her own miscarriage (2) Every female person who, being pregnant, with intent to procure her own miscarriage, uses any means or permits any means to be used for the purpose of carrying out her intention is guilty of an indictable offence and liable to imprisonment for a term not exceeding two years. Definition of means (3) In this section, means includes (a) the administration of a drug or other noxious thing; (b) the use of an instrument; and (c) manipulation of any kind. Marginal note: Exceptions (4) Subsections (1) and (2) do not apply to a) a qualified medical practitioner, who with approval from a provincial therapeutic abortion committee, acts in good faith and uses an accredited or approved hospital for the purpose of carrying out his intention to procure the miscarriage of a female person
