Between them they win around 65% of corporate catering contracts in Melbourne, and for the last five years they have had an informal arrangement under which they each agree to only service corporate clients who are located in particular geographic areas of Melbourne. If a potential client approaches them from outside their assigned area, then they recommend that they take their business to the catering business assigned to that area, and if this doesn't work, then they compensate that catering business accordingly. In January 2018, a new catering company, Amazing Kitchen, opens in Melbourne. Amazing Kitchen markets itself successfully, provides great food at affordable rates, and starts to gain several lucrative corporate catering contracts throughout Melbourne. Trenton, Alton and Elsa meet one Sunday morning in March 2018 for brunch, in order to discuss their issues with Amazing Kitchen. They agree that they will lose a lot of money if Amazing Kitchen continues to grow and decide to do something about it. By the end of their second coffees they have agreed to cut their prices by 20% for at least six (6) months to drive Amazing Kitchen out of business. They also agree to offer an additional discount of 15% to any corporate clients who agree not to do business with Amazing Kitchen. By August 2018, Amazing Kitchen is struggling financially and may soon have to cease trading. Trenton, Alton and Elsa meet up again, this time for drinks, to celebrate their commercial success and decide what to do next. Trenton would like to raise his prices back to January 2018 levels, but Alton and Elsa argue that it is too soon and they need to hold firm a little longer. When they are unable to resolve their differences, Trenton says his goodbyes and goes home. Alton and Elsa stay on and, buoyed by their success against Amazing Kitchen, start talking about their longstanding arrangement with Trenton. By the end of the evening, they have agreed to each demand a larger geographic area of Melbourne and to force Trenton out of most of the CBD. When they inform him of their plans the following day, Trenton is shocked and angry. He comes to you for legal advice. In your letter of advice, advise Trenton as to his legal situation under the Competition and Consumer Act 2010 (Cth) ('the Act'): (a) Has Trenton's conduct breached any sections of the Act?
