Ian, aged 19, is charged with raping Jill, a neighbour's 17-year-old daughter. It is alleged that he invited her to his flat for coffee and committed the offence there. When Jill returned in the early hours of the morning to her parents' house, where she was living, she was met by Ken, her father. Ken says that Jill was in tears and that he asked her where she had been. At first Jill refused to say anything except that she had been out with Ian. Ken then said, 'That boy has misbehaved himself with you, hasn't he? If you don't tell me the truth, I can never trust you again.' Jill then said that Ian had raped her. Ian, when interviewed by the police, at first denied having sexual intercourse with Jill. Then he said, 'Well, all right. We did have sex, but only because she insisted. She said she'd had it with all the boys in our road except me, so I did it.' He wishes to call Larry, Mick, Nigel, Oliver and Peter to give evidence that Jill had persuaded them all, individually, to have sex with her after saying that she had had sex with all the other boys in the road. Ian has one previous conviction for taking a motor vehicle without the owner's consent. Discuss the evidential matters arising.
