Legislation signed into law this week prohibits burning of certain materials in rural residential burn barrels around the state.
The legislation, sponsored by state Rep. Ken Kurtz, R-Coldwater, amends two sections of the Natural Resources and Environmental Protection Act to prohibit the uncontrolled burning of plastic, rubber, foam, chemically treated wood, textiles, electronics, chemicals or hazardous materials.
"The bill's about three things," said Brad Wurfel, spokesman for the Michigan Department of Environmental Quality. "One is getting the worst of the worst toxins out of burn barrels. The things that have been prohibited are the worst things to set on fire. It leaves rural Michigan residents the opportunity to dispose of other items like yard waste and cardboard."
The legislation also is intended to increase awareness of the dangers of burning certain items and to give local law enforcement a way to police the activity, Wurfel said.
Wurfel doesn't expect people to immediately tune in to the change.
"The DEQ is under no illusion that this will happen overnight," he said. "We recognize it is cultural, and this is a right they presume they have."
Wurfel said in rural areas of Michigan, burning is preferred by residents to disposal of waste. The state, he said, is trying to educate people about the danger.
"General household waste contains more toxic components than ever before, releasing all kinds of toxins that come out of burning this material," Wurfel said.
Michigan is the last of the Great Lakes states that allowed rural residents to burn household waste in burn barrels, and one of only 10 states in the nation that allowed it, Wurfel said.
The DEQ started to work on the issue about five years ago, he said.
"There was public concern expressed from rural residents around the state," Wurfel said. "One might think the burn barrel culture is in one region, but it's not."
Wurfel said many communities have local ordinances to deal with what can be burned.
