If a person was denied California state disability benefits because the psychologist and therapist that a reputable hospital {such as Kaiser} referred you to them and you want to argue that it is unreasonable for a patient to conduct their own licensing search or penalizing a patient for not knowing that this facility's therapist or psychologist was not licensed, is there any precedents where benefits were granted under similar circumstances. I am in a mock trial but I haven't been able to locate a case. Here, Kaiser [just using this name] referred my client to an outside therapist. However, when my patient asked that therapist who was employed by the psychologist of that facility and submitted the certification, my client was denied due to the licensing status of that psychologist. My argument would be: why should my client be punished for not knowing if they were licensed or not so I want to include precedents; if any.
