If an employer has absolute privilege, then it is immune to defamation claims. An employee would not be successful in bringing a defamation claim when the statement is subject to absolute privilege. Even if the plaintiff can show that the employer acted with malice or knew the information was false, the absolute privilege would still be a defense. This type of privilege "typically applies to judges, legislators, jurors, and witnesses in legal proceedings."[3]
