1. If married parties have not entered into a domestic contract, then the rules of the Family Law Act apply. Under those rules an equalisation of net family property is made. The court has power to decide that certain circumstances would make such a payment unconscionable and therefore has power to make a variation of share, explain two of those circumstances.
