IMPROVEMENT ASSIGNMENT UNIT 02 GRADES: Your grr}de on the pmviops Unit 02 Negligence Scenario will stand; however, you have the opportunity to earn a higher grade on this 50-point assignment, and to demonstrate your learning to me. Think of this kind of like a take-home quiz. In fact, I used to ask a similar question on the Unit 02 quiz, but have since removed that set of essay questions from the quiz and replaced it with this assignment. Follow the directions below to proceed with this assignment. NEGLIGENCE SCENARIO IMPROVEMENT ASSIGNMENT DIRECTIONS Identify which category you fall under, and follow the directions for that category. CATEGORY 1: You previously completed Analysis Assignment-02-Negligence Scenario, you are satisfied with your grade, and would like me to repeat that numerical score for this assignment. You do not need to submit anythingI will copy over your score from the AA-02 assignment. CATEGORY 2: You previously completed Analysis Assignment-02-Negligence Scenario, for which I provided some general feedback as to what your answers should look like and how they should be organized. I may have also made suggestions regarding the scenario you chose. For this assignment, you should a) Answer the same questions, repeated in (1-4) below. b) Incorporate any suggestions I made about your factual scenario (I may have suggested that you use a different scenario or a different type of scenario). Use the appropriate terminology in discussing the elements of negligence and applying your facts to those elements. \\ - d) Organize your answer appropriately, following any guidance or examples I provided in your previous feedback. c) CATEGORY 3: You did not submit an assignment for the Unit 02 Negligence Scenario, you submitted your previous assignment late, you submitted an incorrect assignment, or you submitted an unacceptable file. Describe an example of a potential negligence situation that you have faced or someone you know has faced. Do NOT use a case that has already gone to trial and/or appeal. The example you describe may or may not actually be negligence once you apply the facts to each elementyou should be able to explain this. * Every semester, some students think they have (or someone they know has) never experienced a potential negligence situation. Most of us have experienced potential negligence at some point, but we consciously or subconsciously choose not to sue over it. If you are struggling to come up with an example, you are likely over-thinking what negligence is. Search online for examples of negligence just to get you brainstorming for the right kind of thing. 1) Summarize the events that occurred (describe the facts). 2) Identify the plaintiff (victim) and defendant (person or business entity the victim would sue) 3) List each element of negligence, as outlined in the PowerPoint slides for Chapter 07. -_ 4) In a separate paragraph, for each element listed in (c), explain briefly what that element means in general (define it in your own words). Then analyze the facts you listed in (a) and determine whether your plaintiff can present evidence of that element in order to make a prima facie case of negligence against the defendant
