In ACA and TAC terms and using additional research, discuss Professional Competence? What is the difference between professional and emotional competence? Why do you think it is addressed?

Using ACA guidelines and TAC and other research and based on your professional competence, how would you respond to the following situations?

You become aware that another student in your program just entering his internship was charged with domestic violence over the weekend. He has told other students that he has difficulty maintaining his temper from time and that he "goes off" when tired and frustrated. His internship involves work with adolescent males with a history of oppositional defiant behavior. The intern has not confided this information directly to you, but has told his story to your friend, who has been his confidant over the course of his time in the counseling program. Your friend asks you to keep this under your belt because what he (the student just entering the internship) does on his own time and is no one else's business. You believe that this student's problems (what you have been told) are likely to effect clients during the internship and could negatively impact the counseling program and the University. What is an appropriate response?

You are a counselor-in-training. For your internship you're working with college students on campus. Your intern group meets with a supervisor each week to discuss your cases. One day while you're having lunch in the campus cafeteria with three other interns, they begin to discuss their cases in detail, even mentioning names of clients. They joke about some of the clients they're seeing, while nearby are other students who may be able to overhear this conversation. What is an appropriate response?

You're counseling children in an elementary school. Barbara is referred to you by her teacher because she is becoming increasingly withdrawn. After several sessions Barbara tells you that she is afraid that her father might kill her and that he frequently beats her as a punishment. Until now she has lied about obvious bruises on her body claiming that she fell off her bicycle and hurt herself. She shows you welts on her arms and back but tells you not to say anything to anyone because her father threatened a worse beating if she tells anyone. Briefly assess this situation and pose an appropriate response.

Counselors may be subpoenaed to provide a deposition or court testimony in matters where they are not a defendant, but ae or were involved in the assessment and/ or treatment of a client who is involved in a legal action. Similarly, they may receive a subpoenas or requests for clinical records. How would you respond to this request? What is the very first thing that you must consider in responding to a subpoena request? What are some other things that you might consider (ex. privileged communication, confidentiality, types of information?).
