In BariWeinberger'sDivorce 101 video she breaks down the divorce process in a simple manner for prospectiveclients or for those who are just learning the field. She starts off by telling the audience how New Jersey is a no-fault state which means that the plaintiff does not need to identify the reason for the divorce(adultery;domestic violence)which is beneficialsince it is public records. There just needs to be proof that there has been a breakdown in the relationship for at least 6 months.

Next, she explains the process of mediation which is an important step, because not many of those who are filing for divorce can amiablycome to an agreement. During this the individuals sort out their differences between child support, assets, or retirement. Furthermore, once a person files for divorce they become the plaintiff, and the other party has 35 days to answer the counterclaim. If that person does not answer then a default is issued so the plaintiff can move forward with the process.

The stage of case managementcomes after the counterclaim, whichthe defendanthas filed, the attorney meets with judge in the court to schedule discovery & determine if expert witnesses will need to be present.

Lastly, temporary motions are available when the party needs temporary relief, or help from the court foralimony, visitation, or anything else that cannot be met.I would post the video on the law firm's website & suggest it is highly recommend that a prospective client watches the video to understand the divorce process on a basic level & follow up with any questionsto the paralegalwho can answer these procedural questions. That way the attorney can have more time discussing the legal portions of the case. The client will then have a better understanding of what to expect when moving forward with this difficult process.This video would be helpful since it clearly and simply explains the process. As a future paralegal who has interest in this particularfield it was interesting to see the procedural breakdown of how filing a divorcehappens, since this is something I will be doing first hand. Another interesting note was how New Jersey is a 'no fault' state, so you do not have to provide the reason for your divorce.Overall, it was a good preliminary video to demonstrate the steps when filing a divorce.
