In Copeland v. The Lodge Enterprises, a woman was suing the hotel for damages she suffered from being bitten by a brown recluse spider at the hotel. How did this case ultimately get decided? The woman lost since there is no way a hotel can control for all insects. The hotel lost because the innkeepers duty of care to invitees is non delegable; including that of pest control. The woman won the case but the hotel was not found liable. It was actually the pest control company that had to pay damages. The hotel won because they had already fired the first ineffective pest control company and hired a new contractor which satisfied the court that they had done all they could.
