In light of your reading assignment this week, imagine the following scenario which is based on an actual situation. An employer narrows down their search to their top two candidates. This candidate will be filling an engineering roll in a very small team of 6 people. The manager of the department looks into the candidates social media accounts. The top candidate has photos filled with nights out at clubs, posts about drinking, and photos of make-out sessions with people of both genders. With a concern over how this person will mesh with the other personalities on the team, and with a concern over reliability from someone who parties substantially on weekends and weekdays, the department manager offers the job to the slightly less qualified candidate.
Based on your readings on privacy, and if you had a chance to talk to the department manager prior to hiring, what would your advice be? Is there any legal case law that might apply? A word of caution: do not base this merely on your opinion, which could be slanted based on what type of photos are on your social media, but consider the law, the privacy issues, whether social media reflects employment reliability, etc.
