In the case: Tegman v. Accident & Medical Investigations, Inc., 107 Wash.App. 868 (2001), answer the following questions.
Hypothetical 1:
Anna Lee has just graduated from paralegal school, where she focused on probate and real estate work. Her best job offer is from a big firm, Billings & Conroy, which has asked her to work in the litigation department until there is an opening in probate or real estate. She is assigned to work for a first-year associate, Bob Brown, on a new antitrust case that has just come in. Bob asks Anna to draft a motion to dismiss the case.
- Anna has no idea how to begin and knows littleabout litigation, let alone the intricacies of federal court and antitrust law. What should she do?
- Anna figures out how to draft the motion and gives a very rough draft to Bob for guidance. He says it is fine and asks her to file it as is. Anna knows it is not very good and is concerned that Bob has not reviewed it carefully and may not know any more than she does about the law and procedure in the case. What should she do? Is Bob acting competently?
- What might happen if it is filed as is and is seriously deficient?
Hypothetical 4:
Jan Jones is a paralegal for a small firm, Kingfield & Knowlton. The firm has grown dramatically in the last year, and everyone is working 60 or 70 hours a week to keep up with the workload. Jan is at her limit of stress and believes that she cannot handle one more client matter. As Jan is leaving the office one day at 5 p.m. to pick up her child from child care, Kent Kingfield passes her in the hall and hands her a phone message from a new client and says, "Call this guy back and tell him that we will have the contracts ready tomorrow. Find the Smith file and draft the contracts, using the Smith contracts as a model. I need them by 9 in the morning."
- What should Jan do?
- What should the firmdo to change the way it is working?
- Assume that Jan drops everything, calls the client, arranges for a friend to pick up her child, and drafts the contracts that night, working until midnight. In her exhaustion, she transposes some numbers and the consideration for the contract is stated incorrectly. She sees this after the contracts have been signed and sent to the other contracting party. What should she do?
