Ed ward Pagan Yesterday 1. What is a criminal to you? A criminal is someone who has committed a crime or a violation of a law. Criminals are people who have been found guilty of breaking said law, but only when they are found guilty. If a person is found innocent, they are not a criminal. 2. What is the difference between criminal law and criminal procedure? Criminal Law is like the California Penal code which denes laws and the punishments that can happen when breaking that law. Criminal Procedure is how criminal cases are handled in the legal system. All entities that are involved with the legal system play a role in carrying out a criminal case such as district attorneys, defense attorneys, judges, police departments, etc. Once someone is accused of a crime they all follow the criminal procedure respectively. 3. Criminal procedure is a concern with the US. Constitution rights because....? The US. Constitution provides protection and rights to someone who is directly involved in the criminal justice system. These protections and rights make sure that there is a fair process while involved in the criminal justice system, 4. Why is the dual court system needed? The dual court system is needed mainly due to crimes that each of the courts deal with. Federal courts deal with federal laws that have been broken, such as national and constitutional matters. And state court systems handle matters that are more local and of a concern to the state rather than the federal government. The dual court system is needed because of the various legal issues that come into a court room. One is better at handling a certain matter than the other mainly due to what it specializes in.
