In the course, we reviewed certain concepts that provide a legal and regulatory framework for addressing quality of care in the provision of healthcare services, and within our study discussed the legal cases that were presented to illustrate how the courts think through those concepts. The understanding of the legal concepts and their regard within the judiciary helps to learn the legal and regulatory influences on quality assurance programs within the healthcare services organization. 1. From the class sessions and Chapter 4 in the textbook of "Law and Health Care Quality, Patient Safety, and Liability", address the following: a) Discuss the meaning, formation, and application of the "Professional-Patient Relationship" as a legally defined concept to determine the physician's (healthcare practitioner's) duties to the patient, and explain how the concept is illustrated within the Lection v, Dyll legal case, noting the meaning and relevance of the points made in the Notes and Questions following the case (pp. 121 - 130). b) Identify and define the four (4) "unique duties" (page 121) that the authors consider as triggers in the formation of the physician (practitioner)-patient relationship, giving a description of each duty with the legal criteria for the duty to be in effect, and explain how each duty is illustrated in the legal cases pertaining to the duty, noting the meaning and relevance of the points made in the Notes and Questions following the legal cases.
