Increasingly concerned with the health and safety consequences of drinking alcoholic beverages during commercial flights, Congress decided to amend existing statutes. Congressional hearings revealed that alcohol is often not safe to drink at high altitudes. In early 2022, Congress passed legislation banning the consumption of alcohol on flights between two cities in the United States. 

Carina and Sarah were on a flight from Cleveland, Ohio heading to Seattle, Washington. During this flight, Carina and Sarah both consumed three shots of J agermeister, which they had snuck on to the plane to make their flight more enjoyable. While Carina had recently turned 21, her friend, Sarah was 20 years old at the time. The flight attendant noticed the bottles and reported it to the authorities in Seattle upon landing. Immediately after deboarding, Carina and Sarah were arrested and subsequently convicted in federal court for violating the new federal statute. Carina and Sarah challenged their convictions arguing that Congress did not possess the authority to pass such a law under the Commerce Clause.
