Overview

Research is the essence of scholarly discourse. The graduate student should, at a minimum, be given to critical thought in a way that exposes gaps in the literature and offers new insight to more improved methodologies and policymaking. For this course of study, you should identify critically apparent flaws in current cybercrime policymaking and offer improved pathways to digital intelligence, enforcement, crime reduction and prevention.

Instructions

The exact requirements of theProblem Paper: Search Warrant Assignmentare outlined as follows:

• Length of assignment (6 six; double-spaced; Arial or Times New Roman font; 12 pt.
• Format of assignment: APA
• Number of citations: 6
• Acceptable sources (e.g., scholarly articles published within the last five years)

This should not be a descriptive paper but one that critically examines current problems and contemporary solutions. You should make an argument or prove a point. You will be required to make some technical assumptions and devise alternatives based upon the material you are studying. Regardless, a response template (attached) will be provided to the student to reduce confusion as to what is required for the particular assignment.

Format:

Include the following elements in your short essay:

• Discuss thelegal,policy, andtechnicalissues involved with each facet of this scenario critically examining each point and conclude by offering a resolution(s), if any.
• Remember toidentify,assess, andinterpretall of the evidence before you.
• Bibliography (or Reference page) of the sources you cited in the short essay
• Review the Problem Paper Grading Rubric to see how this assignment will be evaluated.

Problem Scenario:

• Read the included search warrant (Case #15-190459). (PDF of search warrant embedded in Word document on next page).WARNING: This search warrant contains explicitly described and disturbing sexual content.
• You are a certified digital forensic examiner and retired police officer hired by a local attorney who deals primarily in criminal cases and representing clients who have been charged with Class A felonies. The attorney tells you that his client, Randall M. Peterson, has just been arrested by the police for Rape of a Child in the First Degree and Sexual Exploitation of a Minor. Your attorney has asked you to read the search warrant and provide him with an assessment of what you might believe to be of concern to him.
• As the defense expert on the matter, discuss all of the issues to this point and then direct, explain, and discuss any further issues that will or potentially may arise as a result of your direction in this matter.If something legal, policy wise, or technical does not obviously appear in the search warrant, assume that it does not exist or did not occur. Indeed, there are many unknowns here in this scenario. It will be up to you to provide the most comprehensive assessment possible.
