SECTION A: BUSINESS LAW All questions carry equal marks. Answer Question 1 and any ONE from the other TWO questions. Question 1 (25 marks) Brad has received an invitation to a job interview. On the day of the interview, he decided to drive to the interview venue. Brad has just obtained his driving licence for a year. He rarely drives on busy roads as he is not confident, and he is fearful that the stress of driving would trigger his anxiety problem. On the day of the interview, he felt that he had to drive to avoid the risk of being late by using public transport. During his journey, Brad started to feel more and more anxious due to the busy road condition and shouts from angry drivers. He suffered from a panic attack which caused him to drive above the speed limit. He drove into the back of a car driven by Carlo who had stopped at a red light. Carlo suffered a broken leg and hit his head against the side of his car. Carlo was conscious when he was taken to East Kowloon Hospital (the "Hospital) where he was attended to by Dr Ding who was a junior medical doctor, as there was no experienced medical specialist present to treat him at that time. Dr Ding decided to treat his broken leg first, instead of sending him to have a CT scan of his head, since he considered that it was unlikely that his head would have sustained any significant injury. Such practice is contrary to current protocol of the Hospital. Carlo's head injury has not been treated. He suffered internal bleeding in his brain which would have been revealed by a CT scan, and he lost consciousness. His condition worsened and he remained in a vegetative state.
