IUI L3 The word tort means "wrong." A tort is a civil wrong other than a breach of contract. Tort law sets limits on how people can act and use their resources so they do not violate the right others have to their resources. Legal wrongs inflicted on the resources of others may be crimes as well as torts. But the law of tort is civil rather than criminal and the usual remedy for tort is dollar damages. Behavior that constitutes a tort is tortuous behavior. CONCEPT REVIEW: Intentional torts and negligent torts are two categories oftorts discussed in this exercise. Intentional torts involve deliberate actions that cause injury. Negligence torts involve injury following a failure to use reasonable care. Intentional infliction of mental distress is a battery to the emotions. It arises from outrageous, intentional conduct that carries a strong probability of causing mental distress to the person at whom it is directed. Defamation is the publication of untrue statements about another that hold up that individual's character or reputation to contempt and ridicule. "Publication" means that the untruth must be made known to third parties. There are two (2) basic defenses to a claim of defamation. One defense is that the statements made were true. The second defense is that the statement arose from privileged communications. For example, statements made by legislators,judges, attorneys, and those involved in lawsuits are privileged under many circumstances. Intentional interference with contractual relations involves intentionally inducing a party to breach an existing contract. The unintentional tort of negligence involves unreasonable behavior that causes injury. In the United States, more lawsuits allege negligence than any other single cause of action. Negligence takes place when one who has a duty to act reasonably acts carelessly and causes injury to another person. Case Analysis Read the following scenario and answer the questions that follow. Callie owns a bakery, Callie's Cupcakes, that receives all its baking supplies from its long-term supplier, Sam of Sam's Baking Supplies. At a cocktail party, Callie runs into her rival baker, Betty, and states, "Instead of being fierce competitors, we should merge our cupcake operations and run this town." Betty replies, "I'd never go into business with you, you're an incompetent businesswoman who doesn't pay taxes."
