Jack decides to sell his two-year-old stereo unit, and he thinks that his friend Jenny might like to buy it. As Jack is going away for a few days, he sends Jenny a message by electronic mail ("email") on 1st November as follows:-
"Jenny. I am selling my stereo unit. I think it is worth $700.00 without the CD player. If
you want to buy it, send me back an e-mail and I will arrange delivery when I get back
from Tasmania next week. Cheers. Jack."
Jenny sees Jack's by email on her computer that night (1st November) when she reads her e-mail, but she is too tired to make a decision.
The next day, when Jenny tries to send an by email to Jack, her computer is playing up and she cannot connect with her e-mail server. Jenny, therefore, posts a letter to Jack stating:- "Jack. I will buy your stereo for $700.00 if you will include your CD player in the price. Call me when you get back from Tasmania."
Jenny posts this letter to Jack on 2nd November.
On 4th November, Jack is still away in Tasmania and Jenny's e-mail is now working properly. She sends an by email to Jack on 4th November saying:-
"Jack. Ignore my recent letter. I will buy the stereo unit for $700.00 without the CD player. Let
me know when you get home and I will pick it up. Jenny."
Jack returns home on 5th November, reads Jenny's letter, and takes his stereo unit to Cash
Converters (a business which buys and sells second-hand goods) and sells it for $1,000.00.
Later that day, Jack reads his by email, including Jenny's message of 4th November. Jenny seeks your advice as to her rights. Advise Jenny.
