Jael works with Montrel Company Ltd, dealers of food and beverage products. As a mother of three in an abusive marriage, Jael resort to drinking for relaxation. She was suspended for attending work under the influence of alcohol, though Mr. Kinsh, the supervisor was aware that she had an alcohol dependency. She was invited to appear before the disciplinary committee, where Jael accused the supervisor of sexual harassment, but without proof. As a result, the management required that the Jael sign a “last chance agreement” to abstain from alcohol and undergo treatment. Jael failed in adhering to the agreement and her appointment was terminated.
The Workers Union intervened on Jael’s behalf in relation to the termination, due to her condition and she was reinstated. However, Jael’s appointment was terminated again shortly thereafter, for alleged breach of the reinstatement terms. Jael filed a discrimination complaint with the Labour Commission after the union refused to intervene again. The employer contested the jurisdiction of the labor commission in this issue since it was a breach of the employment contract.
The company for some time was facing liquidity issues due to a major breakdown of their machines caused by serious flooding, affecting production and sales. Likewise, the Union was in dialogue with management on salary increments for the employees, which the management is contesting. To press their concerns, the employees of Montreal gathered in front of the company with placards.
In reaction to this, management decided to close down the business and/or sell out the business. During the lockout discussion, a portion of the management was able to convince the team of the consequences of the lockout. The management, therefore, called for an intervention from the commission to help resolve the issue.
