Jai has just opened a new wine touring company. To ensure his new business is successful, he decides he will copy 'Wine Tours' which is a successful wine tour company. He calls his company 'Grapevine Tours' and uses a similar logo to the existing wine tour company.
Jai also puts an advertisement in a magazine that says "experience our wine tours in a luxury bus with a gourmet lunch provided." The magazine advertisement also features pictures of various activities such as many different wineries, wine tasting and wine appreciation courses. A small sign is placed in the advertisement which says "all included".
Amal and Ashvin see the advertisement, Amal has always wanted to learn more about different wineries, wine making and wine appreciation. They decide to book.
When they arrive they are told that there is no wine appreciation courses and that they will only visit one winery. They are offered a course on wine making that costs an extra $100. They are also disappointed about the tour bus - which is very basic and not air-conditioned and the lunch that is provided was only sandwiches.
Discuss, using examples, where you consider Jai might be in breach of section 18 of the Australian Consumer Law. Include case law.
