Jannal is a 17 year old high school student with exceptional basketball skills. Jannal's coach and gym teacher, Coach Mango, thinks that Jannal can easily become a National Basketball Association (NBA) professional basketball star. Jannal, however, is very depressed because he lives in small town northern Ontario, population 600 people, he has skipped two grades because of his intelligence, and he feels like he will never leave that dead-end small town. Coach Mango sees a great opportunity, and so Coach Mango persuades Jannal to sign a contact with him, and have Coach Mango be his basketball agent to represent him as a professional basketball player. Jannal signs the representation contract, and Coach Mango pays Jannal a $50,000 signing bonus (Coach Mango took out a second mortgage on his house to get this money). The representation contract says that Coach Mango will receive 50% of all salary or contract money that Jannal earns for the next 10 years. Three months later, Jannal turns 18 and heads to Laurier University. While playing basketball one day, Mark, a talent scout for the NBA, sees Jannal playing basketball and approaches him. Mark offers Jannal $1 million dollars in a signing bonus, and that Mark will only take 10% of future earnings for the next 10 years, if Jannal signs a contract for Mark to be his basketball agent. Jannal thinks this is a far better deal than what he has with Coach Mango. Jannal decides to ignore the contract with Coach Mango and sign the new contract with Mark. Coach Mango discovers that Mark has signed this new contract and has breached the contract with him. Coach Mango decides to sue Jannal. Explain the legal arguments in favour of Coach Mango and potential remedies available. Explain the legal arguments in favour of Jannal and potential remedies available.
