Jarrad lives on a property in Hobart. He has collected a lot of old fence palings and metal containers. The property needs a general tidy up.
Jarrad regularly attends the West Hobart Hotel on Friday nights after work. On Friday the 20thMarch 2020 Larry also attends the hotel and he enters into a conversation with Jarrad. Jarrad explains to Larry that he wants to have a tidy up at his property in Hobart and provides Larry with the address. He explains that he would like to arrange for someone to attend the property and to remove all the fence palings and metal containers. He asked Larry if, in Larry's opinion, anyone would be willing to remove these items without charging but just in exchange for the right to sell the fence palings and metal containers.
On Monday the next week Jarrad travels to Launceston for work. When he returns on Tuesday the 24 March, he notices that the fence palings and metal containers from his property have been removed.
He telephones Larry who confirms that he had accepted his offer to remove the fence palings and the metal containers and that he has now sold them to Boris.
Jarrad is upset. He believes that there was no offer and that Larry has taken the fence palings and metal containers without his permission.
