Question
Jeffrey works for the local NHS hospital and usually parked his car in the hospital's car park. Due to the increased number of hospital admissions
Jeffrey works for the local NHS hospital and usually parked his car in the hospital's car park. Due to the increased number of hospital admissions the car park on occasion lacks free parking spaces. To resolve the problem, Jeffrey agreed with his friend Susan, who lives nearby, that he should be able to park his car when needed free of charge in her driveway.
However Susan's husband Ed became increasingly unhappy about this arrangement and after discussion with Susan, Ed repeatedly asked Jeffrey to stop using the drive. Nevertheless, Jeffrey continues to park his car there even when the hospital car park has available parking places.Jeffrey feels he has the right to do so because he argues that his using the drive does not cause any damage to Ed's and Susan's property.
Using relevant case law, advise Jeffrey in relation to the potential liability arising from this scenario, including possible defences and the available remedies.
