Jenny is employed as a receptionist in a real estate agency. Every Friday before lunch, most tenants pay their rent which is then put in a safe in Terry's office. Terry is the manager and he is the only one who knows the combination to the safe. One Friday, Terry decides to leave work early and go to the pub. He tells Jenny he is going to work from home but she is annoyed because she knows this is a lie. Jenny is sick of having to cover for Terry while he takes regular trips to the pub during work hours and she thinks she ought to be recompensed for the extra work.Jenny goes to Terry's office to write a note saying she deserves an extra $500 in her pay packet this month due to the extra work she has had to for him. While she is in his office, she finds a piece of paper with what she thinks is the combination to the safe. She tries to use the combination but it doesn't work. This was because the number wasn't the combination at all, but a receipt number that Terry had jotted down that morning. Jenny decides to try to open the safe with a small fruit knife from the staff room. While she is doing this, Terry enters the office. He is quite intoxicated, having consumed five vodka martinis at the pub. Surprised, Jenny turns around with the knife in her hand but drops it. Before she can say anything, Terry tackles her to the ground.
Discuss the criminal liability of Jenny.
