Jerry Young and Lynn Masters had an intimate relationship, but were never married. Masters broke off the relationship and moved out of Young's apartment some time in March or April of 1990. On June 2, 1990, Young saw Masters, her two year old daughter, and her fianc, Tom Vick, in an automobile. Young, in a rented car, followed them to Vick's apartment. Young blocked Masters' exit from the car, and they exchanged words. As Masters tried to get past him, Young shot her twice in the back, killing her. Vick fled on foot. Young chased after Vick and caught up to him when Vick tripped and fell in a nearby field. Young then shot Vick in the chest. Vick rolled onto his stomach, and Young shot him again in the back. Vick was seriously injured, but he survived. Young appealed his first degree murder conviction, claiming that he had been provoked. Discuss the law and facts to decide on the appropriate homicide charge.
