On 1 January this year, Jim entered into a 10 years contract of service to work as the chief engineer for Judd Mining NL at a salary of $100000 per year. Judd Mining NL paid Jim $20000 as consideration for entering into the contract. On 31 May this year, Jim received an offer from Arg Diamond to work for them at a salary of $150000 per annum. Jim asked Judd Mining to release him from the contract and they agreed providing Jim makes a payment of $50000 for the release. Jim made the payment on 30 June this year and was released from the contract. After one year of working with Arg Diamond, Jim received $40000 from Arg Diamond for entering into an agreement in which Jim agreed to be bound by a restraint of trade condition that he will not work as a diamond mining engineer for two years following his future termination of employment with Arg Diamond.
