If Joe does get that offer, he will need to relocate quickly to the New York area. To facilitate timing on a move should that become necessary, Joe contacts Residential Real Estate, Inc. and signs a listing agreement whereby Residential Real Estate, Inc. agrees to list Joe's home in St. Louis for sale. Joe lists the property for sale for $400,000. On the first day that the property is listed, Tommy Buyer submits an offer for the full asking price of $400,000. Joe is still not certain that he will be moving but believes that this is too good an opportunity to pass up and signs the agreement. Later Joe finds that he is not going to be offered the job in New York and wishes to stay in St. Louis and does not want to complete the sale of his residence. a. Please discuss each of the contracts which Joe has entered into and the remedies available to the other party to each of the contracts in the event that Joe does not perform. b. Assume that Joe does complete the sale of his residence in St. Louis and after the sale is closed the buyer files a lawsuit claiming that Joe had promised to leave certain items of personal property including pool table, built-in bar and shelves in the lower level, and various wall decorations.
