Joe is a crew chief for Green Acres Landscaping, LLC, a landscaping architecture and design firm. Joes job includes managing work crews, making sure equipment is gassed up and in good working order, driving crews to job sites, and the like. Joe has no responsibility for purchasing plants or other landscaping material.

Last night, on the way back from a job, Joe noticed a pop-up stand where a local farmer was selling apple seedlings. Based on his work over the years, Joe believes the seedlings are of high quality and that they are being offered at a good price. He decides to purchase some and bring them back to David, the owner of the business, having assured the farmer that David would pay for the trees. Is David bound by Joes purchase? Why or why not? What if David takes a look at the trees and says, Thanks for picking them up, we can use them on the Goodman job next week?
